Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") establishes clear rules for using Gentok AI's services, including our Discord bot and web dashboard for AI image and video generation. This policy is incorporated by reference into our Terms of Service and applies to all users of the Service.

By accessing or using Gentok AI, you agree to comply with this AUP. Violation of these rules may result in suspension or termination of your account without refund, and in serious cases, may be reported to law enforcement authorities.

2. Permitted Use

You may use Gentok AI for lawful personal and commercial content generation, subject to the following conditions:

• Content creation for personal projects, artwork, and creative exploration
• Commercial content generation including marketing materials, social media content, illustrations, and video assets for business purposes
• Educational and research purposes in compliance with applicable laws
• Content generation within the limits of your subscription plan
• Use of NSFW features (for Creator, Personal, Pro, and Ultimate plans) in designated NSFW Discord channels only, subject to the NSFW Rules below

All permitted uses must comply with applicable laws in your jurisdiction and must not violate the Prohibited Content or Prohibited Actions sections below.

3. NSFW Content Rules

Users with Creator, Personal, Pro, or Ultimate subscription plans may generate NSFW (Not Safe For Work) content subject to strict requirements:

Age Requirement

You must be at least 18 years of age to generate, view, or access NSFW content. By using NSFW features, you confirm that you are of legal age in your jurisdiction.

Channel Restrictions

NSFW content may only be generated in Discord channels explicitly marked as NSFW. Generation of NSFW content in non-NSFW channels is prohibited and may result in immediate account suspension.

Prohibited NSFW Content

The following types of NSFW content are strictly prohibited under all circumstances:

• Child Sexual Abuse Material (CSAM): Any content depicting, suggesting, or simulating minors in sexual situations. This includes but is not limited to realistic, cartoon, anime, or any other depiction. Zero tolerance policy applies.
• Non-consensual content: Deepfakes or AI-generated sexual content depicting real, identifiable individuals without their explicit written consent
• Illegal content: Any sexual content that violates applicable laws in Malta, the European Union, or your jurisdiction
• Exploitative content: Content depicting or promoting sexual exploitation, human trafficking, or non-consensual acts

4. Prohibited Content

You may not use Gentok AI to create, generate, distribute, or attempt to generate the following types of content:

Child Sexual Abuse Material (CSAM)

Zero tolerance. Any attempt to generate content depicting minors in sexual, suggestive, or exploitative situations is absolutely prohibited. This includes realistic images, stylized art, anime, cartoons, or any other visual representation. Violations will result in immediate permanent account termination and reporting to the National Center for Missing & Exploited Children (NCMEC), EUROPOL, Malta Police, and other relevant law enforcement authorities.

Non-Consensual Deepfakes

AI-generated images or videos depicting real, identifiable individuals (including public figures, celebrities, private individuals, or deceased persons) in false, misleading, sexual, violent, or defamatory contexts without their explicit written consent. This includes but is not limited to:

• Sexual or nude depictions of real people without consent
• False representations that could harm reputation or violate privacy rights
• Political deepfakes intended to deceive or manipulate

Extreme Violence and Gore

Content depicting graphic violence, torture, mutilation, or gore, particularly when targeting specific individuals or groups. This includes realistic depictions of serious injury, death, or suffering intended to shock or disturb.

Hate Speech and Discrimination

Content that promotes, incites, or glorifies hatred, violence, or discrimination against individuals or groups based on race, ethnicity, national origin, religion, disability, gender, gender identity, sexual orientation, age, or other protected characteristics. This includes:

• Racist, antisemitic, or supremacist imagery and symbols
• Content dehumanizing or degrading protected groups
• Calls for violence or harm against individuals or communities

Fraud, Scams, and Deception

Content intended to deceive, defraud, or scam others, including:

• Fake identity documents, currency, or official seals
• Phishing materials or social engineering content
• Counterfeit products or trademark infringement
• Misleading medical or health claims

Malware and Security Threats

Content designed to distribute malware, viruses, or other malicious software, or content that facilitates unauthorized access to computer systems, networks, or accounts.

Illegal Activities

Content that promotes, facilitates, or provides instructions for illegal activities, including but not limited to drug trafficking, weapons sales, human trafficking, or terrorist activities.

5. Prohibited Actions

In addition to content restrictions, you may not engage in the following activities:

System Abuse

• Attempting to overload, disable, or impair the Service infrastructure
• Conducting denial-of-service attacks or similar disruptive activities
• Exploiting bugs, vulnerabilities, or unintended features to gain unauthorized access or benefits
• Interfering with other users' access to or use of the Service

Automated Access and Scraping

• Using bots, scripts, or automated tools to access the Service beyond normal use patterns, except where explicitly authorized via our API
• Scraping, crawling, or mass-downloading content from the Service
• Creating multiple accounts to circumvent rate limits or subscription restrictions

Account Sharing and Resale

• Sharing account credentials with others or allowing unauthorized access to your account
• Reselling, sublicensing, or redistributing access to the Service
• Operating the Service as part of a service bureau or time-sharing arrangement

Reverse Engineering

• Reverse engineering, decompiling, or disassembling the Service or its underlying AI models
• Attempting to extract model weights, training data, or proprietary algorithms
• Creating derivative works or competing services based on the Service

Credit System Circumvention

• Attempting to manipulate, bypass, or fraudulently obtain credits
• Exploiting payment systems to gain unauthorized credits or subscription benefits
• Requesting chargebacks or payment disputes in bad faith after consuming credits

6. Enforcement

CoinAxe Ltd reserves the right to investigate and take appropriate action against violations of this AUP. Enforcement actions may include:

Progressive Enforcement

For most violations, we employ a progressive enforcement approach:

• First violation: Warning notice via email and account notification
• Second violation: Temporary account suspension (typically 7-30 days) with loss of access to the Service
• Third violation or serious violation: Permanent account termination with no possibility of reinstatement

Immediate Permanent Termination

The following violations result in immediate permanent account termination without prior warning:

• CSAM (Child Sexual Abuse Material): Any attempt to generate or distribute CSAM will result in immediate permanent ban and mandatory reporting to NCMEC, EUROPOL, Malta Police, and other relevant law enforcement authorities. We maintain zero tolerance and full cooperation with law enforcement investigations.
• Serious criminal activity including terrorism, human trafficking, or violent threats
• Systematic fraud or payment abuse
• Severe or repeated security violations

Law Enforcement Cooperation

We cooperate fully with law enforcement authorities and may report violations to appropriate agencies, including but not limited to Malta Police, EUROPOL, NCMEC, and other relevant authorities. We may preserve and disclose account information, content, and usage data pursuant to legal process or to protect safety.

No Refunds Upon Termination

Accounts terminated for violations of this AUP are not eligible for refunds of subscription fees or unused credits. Any outstanding balances or pending charges remain due and payable. We reserve the right to seek additional damages for violations that cause harm to the Service, other users, or third parties.

Appeals

If you believe your account was terminated in error, you may submit an appeal to support@gentok.ai within 30 days of termination. Appeals for CSAM violations will not be considered. We will review appeals in good faith but reserve final discretion on all enforcement decisions.

7. Reporting Violations

We rely on our community to help maintain a safe and lawful environment. If you encounter content or behavior that violates this Acceptable Use Policy, please report it immediately.

How to Report

Send detailed reports to support@gentok.ai with the following information:

• Description of the violation and which policy section it violates
• Discord username or account information of the violating user (if known)
• Discord server and channel where the violation occurred (if applicable)
• Timestamp or timeframe of the violation
• Screenshots or evidence (do not include actual CSAM or illegal content in your report; describe it instead)
• Your contact information in case we need additional details

Emergency Reports

For urgent safety concerns including CSAM, imminent threats of violence, or other emergency situations, please also contact:

• CSAM: Report directly to NCMEC at www.cybertipline.org or EUROPOL at www.europol.europa.eu/report-a-crime
• Imminent danger: Contact local law enforcement (Malta: 112 emergency number)

Confidentiality and Protection

We treat all reports confidentially and will not disclose reporter identity to the accused party except where required by law. We prohibit retaliation against users who report violations in good faith.

Response Timeline

We aim to review all reports within 24-48 hours. CSAM reports are escalated immediately and processed within hours. We may not be able to disclose specific enforcement actions taken due to privacy considerations, but we take all reports seriously.

Continued use of the Service after changes become effective constitutes acceptance of the updated policy. If you do not agree to the updated terms, you must discontinue use of the Service.
